Tenancy Deposit Explained: What It Is, Who Pays and How Much

Your tenancy deposit in Dubai is refundable security, not extra rent. Learn typical amounts as a guide, who holds it, and how to get it back in full.

A tenancy deposit in Dubai is a refundable security amount you pay to the landlord at the start of a lease to cover genuine damage, unpaid bills or cleaning beyond normal wear, and it should come back to you at the end of the tenancy once the property is handed back in the condition agreed and your final accounts are settled. It is not an extra month of rent for the landlord to keep, and most disputes about deposits happen not over the principle but over paperwork: no condition report at move-in, no receipts, and no clear agreement on what deductions are fair.

Who pays the deposit and who holds it

The tenant pays the deposit, normally when the tenancy contract is signed and before or on the day keys are handed over, alongside the first rent payment and any agency commission. The landlord — or the landlord’s authorised property management company — holds the deposit during the tenancy. Unlike some countries, Dubai does not operate a single government deposit-protection scheme that holds the money for you, which is exactly why your own records matter so much. Your tenancy contract should state the deposit amount clearly, and you should always pay by a traceable method or obtain a signed receipt that names the amount, the property and the date. Keep that proof for the entire tenancy, because you may need it a year or more later.

How much is typical, as a guide

Custom in Dubai, widely reflected in agency practice, is a deposit of around 5 percent of the annual rent for an unfurnished property and around 10 percent for a furnished one, though the exact figure is a matter of agreement in the contract rather than a single fixed law, so always check what your own contract states before signing. As an illustration only, on an annual rent of AED 80,000 an unfurnished deposit at 5 percent would be around AED 4,000 and a furnished one at 10 percent around AED 8,000. If a landlord asks for noticeably more, ask why and have it written into the contract. Separate refundable deposits may also be taken by utility and cooling providers when you connect accounts, and those are returned through those providers’ own processes, not by the landlord.

What the deposit can and cannot cover

  • It can cover unpaid rent, unpaid utility or cooling bills left in a way the landlord must settle, and repair of damage beyond normal wear and tear.
  • It can cover reasonable cleaning or repainting where the contract requires the property to be returned in a particular condition and it was not.
  • It should not be kept simply because the landlord has found a new tenant at a lower rent, or for pre-existing wear that was there when you moved in.
  • Deductions should be itemised and supported by invoices or quotes, not presented as one unexplained lump sum.

How to protect your deposit from day one

  1. Walk the property before or on move-in day and photograph every room, mark, appliance and meter reading, ideally with the agent present, and email the set to the landlord or manager so the date is recorded.
  2. Note existing defects in writing on the handover form or by email within the first days, however small they seem.
  3. During the tenancy, report maintenance issues in writing promptly; unreported leaks that later cause damage are a classic deposit argument.
  4. Before moving out, settle DEWA and cooling accounts, obtain final bills or clearance letters, and complete any agreed painting or cleaning with a company that gives invoices.
  5. Do a joint move-out inspection, agree deductions in writing there and then if you can, and confirm the refund method and timeframe by email.

Refunds are often processed within a couple of weeks of handover once final bills are known, but there is no single automatic timetable, so agree a date in writing. If a landlord refuses to return a deposit without justification, tenants can seek help through the Rental Dispute Settlement Centre, and a clean paper trail is what makes such a case quick to resolve.

FAQ

Is the tenancy deposit the same as agency commission? No. Commission is a one-off, non-refundable fee for the agent’s service. The deposit is refundable security held against the property’s condition and unpaid amounts.

Can the landlord keep my deposit for normal wear and tear? Fair wear from ordinary living — light scuffs, for example — should not be treated as damage. Photographs from move-in are your best evidence of what was already there.

When should I get my deposit back? After handover, final utility bills and any agreed deductions are settled. Agree the amount and date in writing at the move-out inspection to avoid drift.
